Information on how to enter and prize details set out in all communications regarding the Mastercard ‘$0 Minimum Merchant’ Competition (“Promotion”) form part of the Conditions of Entry. By participating in the Promotion, each entrant fully and unconditionally agrees and acknowledges that these Conditions of Entry and the decisions of the Promoter on all matters relating to the Promotion are final and binding.
The Promoter is Mastercard Asia/Pacific (Australia) Pte Ltd (ABN 53 143 050 043), 72 Christie Street, St Leonards, NSW 2065, Australia. The promotional period for this Promotion commences on Monday, 06 May 2019 at 12:01am AEST in Sydney NSW and finishes on Wednesday, 10 July 2019 23:59pm AEST in Sydney NSW (“Promotional Period”).
Eligible entrants must be -merchants who are eligible to participate in the Promotion as set out in condition 5 (“Eligible Entrants”). Employees of the Promoter or the Promoter’s associated agencies or companies directly involved in the Promotion (as determined by the Promoter) and their immediate family members are ineligible to participate.
Entry into the Promotion is open to all persons/merchants who satisfy the following eligibility requirements:
is a citizen or resident of Australia; and
is of the age of 18 years and above; and
holds a valid identification card/document; and
is a merchant;
accepts payments by credit and debit cards;
adopts and displays $zero minimum payment collateral; and
participates in the Promotion by being the merchant of a Qualifying Entry (as hereinafter defined).
To enter the Promotion, Eligible Entrants must undertake the following steps during the Promotional Period:
Merchants sign up to the Promotion; and
Display the Promotion point of sale marketing materials from Wednesday, 12 June 2019 to the Promotion finish date of Wednesday 10 July 2019 (ie the ‘$0 Minimum Consumer Competition’ Promotion Period); and
Merchant must remove the requirement for a minimum amount for card transactions; and
Merchant must remove any current signage and messaging concerning the requirement for a minimum amount for card transactions; and
Hand out consumer competition ‘Mastercard ‘$0 Minimum Consumer’ Competition’ information and unique promo code to eligible consumers making a card payment from Wednesday 12 June 2019; and
The eligible consumer must then complete the entry requirements for the ‘Mastercard ‘$0 Minimum Consumer’ Competition’.
The winner of this Promotion will be the merchant who issues the unique promo code to the winner of the consumer competition (‘Mastercard ‘$0 Minimum Consumer’ Competition’)
Only one (1) unique code is permitted per transaction.
If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
The winner of the ‘$0 Minimum Consumer’ Competition will be drawn at 14:00pm AEST on Monday, 15 July 2019 at MDSA, Level 2, 40 Yeo Street, Neutral Bay NSW 2089. The winner of the ‘$0 Minimum Consumer’ Competition will be notified in writing within two (2) business days of the draw. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The name of the winner (the merchant who issues the unique promo code to the winner of the consumer competition (‘Mastercard ‘$0 Minimum Consumer’ Competition’)) will be announced at https://no-minimums.com.au commencing on Monday, 22 July 2019, for a minimum of 28 days.
The winner of this Promotion will be the merchant who issues the unique promo code to the winner of the consumer competition (‘Mastercard ‘$0 Minimum Consumer’ Competition’), will win and receive their choice of one (1) of the two (2) following prize options;
1 x Billboard outside Chatswood Chase, 345 Victoria Ave, Chatswood NSW 2067 – maximum retail value $49,500
OR: 1 x Full page colour advertisement in the North Shore Times – maximum retail value $6,786
Maximum Total Prize Value: $49,500
The billboard advertisement or the North Shore Times advertisement for the merchant winner will be produced by Mastercard. The merchant will be able to review the advertisement artwork and allowed up to a maximum of two (2) rounds for feedback and/or changes to the artwork.
Merchant winner to maintain the removal for a requirement for a minimum amount for card transactions and to remove any current signage and messaging concerning the requirement for a minimum amount for card transactions during the advertising period of the prize.
The prize will only be awarded once the winner of the ‘$0 Minimum Consumer’ Competition has been verified as eligible, and agrees to accepted their prize. Prize must be booked within one (1) month of notification.
The prize will be awarded to the merchant named on the Mastercard agreement. The prize is subject to availability. Individual prize supplier conditions apply.
Total prize pool value is up to AUD$49,500.
A draw for any unclaimed prizes may take place on Friday 25 October 2019 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner (if one is required) will be notified in writing within two (2) business days of the draw. The winner’s name will be announced at https://no-minimums.com.au commencing on Friday 1 November 2019, for a minimum of 28 days.
In connection with the claiming of a prize, the Promoter reserves the right to request proof from the winner of the ‘Mastercard ‘$0 Minimum Consumer’ Competition’ (i) him/her being a cardholder, and (ii) his/her valid identification, in order for the winner to redeem the prize, failing which Mastercard reserves the right to disqualify such winner and award the same to an alternative winner. This may include requesting the winner’s first and last name, phone number and email address as well as proof of transaction.
Entrants consent to the Promoter using their name, image, video footage, and/or voice for the purposes of this Promotion, in particular, in the event that they are a winner in any media for without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Prizes are not transferable, exchangeable and cannot be redeemed for cash unless specified otherwise. The winners shall accept the prize ‘as is’ and Eligible Entrants acknowledge that the Promoter accepts no responsibility for any variation in the value of the Prize.
Prizes cannot be resold.
In the event of an act of God, war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
The Promoter and its members, financial institutions, associated agencies and companies and their respective directors, officers, employees and agents, shall not be liable for any loss or damage, including any personal injury suffered or sustained in connection with the Promotion or any Eligible Entrant’s receipt or use of any part of the Prizes except for any loss or damage which is due to the negligence or willful misconduct of the Promoter or which otherwise cannot be excluded by law.
To the extent permitted by law, the Promoter and its members, financial institutions, associated agencies and companies and their respective directors, officers, employees and agents shall not be responsible in any way whatsoever in respect of the following: (1) any amount spent on or charged to an entrant’s account in the course of entering the Promotion or for correctness of the details of the purchases and transactions made; (2) technical failures of any kind including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, line failure or the malfunctioning failure or unavailability of any computer, server, cable, line, network, hardware, software, internet service or web site; (3) unauthorised human intervention in any part of the entry process of the Promotion, including but not limited to theft, destruction or unauthorised access to, or alteration of the Promotion; (4) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any entry that is late, stolen, damaged or misdirected or otherwise not received; (6) the delivery of the services provided by Prize Supplier.
The Promoter reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter’s reasonable control adversely affects the Promoter’s ability to conduct the Promotion as contemplated in these Conditions of Entry, subject to state or territory regulation.
If the Prize, or items that are included in the Prize, are unavailable for any reason, the Promoter reserves the right to substitute the Prize or items for prizes with a prize to equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings or the use thereof. It is the responsibility of each Prize winner to seek independent advice on the possible implications this may have on their own financial situation.
If all or any part of any term or condition contained in these Conditions of Entry shall be declared or become unenforceable, invalid or illegal for any reason, such term or provision (or part thereof) shall be deemed severed from these Conditions of Entry to the extent of the unenforceability, invalidity or illegality and the other terms and conditions hereof shall remain in full force and effect as if the offending term or provision (or part thereof) appearing had not been inserted herein.
These Conditions of Entry shall be governed by the laws of the respective state or territory of Australia where the Eligible Entrant resides and each Eligible Entrant agrees to submit to the non-exclusive jurisdiction of the courts of the relevant state or territory of Australia.
If an Eligible Entrant opts-in to receiving further communications from the Promoter and/or its affiliates, the Eligible Entrant’s details, which may include name, address and mobile phone number will be entered into a database and the Promoter and/or its affiliates may use those details to send future marketing materials to the Eligible Entrant. Except where prohibited by law, participation in the Promotion constitutes the Eligible Entrant’s consent to the storage, use and disclosure of the Eligible Entrant’s entry details for the purposes of this Promotion, as set out in these Conditions of Entry and also constitutes agreement by the Eligible Entrant that the Promoter may use overseas facilities to process, store or back up its information. As a result, the Promoter may transfer the Eligible Entrant’s personal information to its overseas facilities for storage. However, this does not change any of the Promoter’s commitments to safeguard the Eligible Entrant’s privacy.
Except where prohibited by law, participation in the Promotion constitutes each winner’s consent to the Promoter’s use of the winner’s name, likeness and opinions on the Promoter’s website for future promotional, marketing and publicity purposes.
Information collected pursuant to the Promotion from Eligible Entrants is subject to the privacy policies of the Promoter, which can be found at http://www.mastercard.com.au/privacy.html and https://no-minimums.com.au/, and will be handled in accordance with all applicable laws in Australia. The privacy policies contain details on how entrants can access, update and correct their personal information and the Promoter’s complain management processes. Entry is conditional on provision of the required personal details.
